Privacy Policy – Choice Gardening Club ('CGC')

CGC data protection and privacy measures are governed by the General Data Protection Regulation (GDPR) (EU 2016/679) and any national implementing laws, regulations and secondary regulations, in the UK and then any successor legislation to the GDPR or the Data Protection Act 1998.  Any personal information obtained by us is also protected by the Data Protection (Jersey) Law, 2005.

1)      Introduction

This privacy policy sets out how we use and protect any information that you provide to CGC (including information provided through the website www.choicegardeningclub.co.uk or other websites through which CGC provides its services to you).

As with all shopping websites and mail order companies, we collect personal information from you when you shop online at www.choicegardeningclub.co.uk  or via our mail order catalogue and placing orders either by phone or post.

We would like to retain your details to enable us to send you information to make your shopping experience as easy and enjoyable as possible. We need it to process your order, inform you of any delays or problems and supply information regarding our exciting new products and offers. 2)      Personal data and basis for collection

The information we collect is:

  •          Your name – so we know what to call you
  •          Email address – so we can email you order confirmations, delivery delays, offers etc 
  •          Delivery address – so we can despatch your order to you 
  •          Telephone number – we’ll only call if we have a problem with your orderDebit or Credit card details – we only ask for these when you place an order and these are not stored  on our system and only used at the time of payment
  •          Transaction Data – details of products and services that you have purchased
  •          Usage Data – including how you use CGC’s services or submit enquiries or queries to us
  •          Marketing and Communications – including your preferences in receiving marketing or surveys from us

Protection of your privacy is taken very seriously by CGC. We do not pass your information to third parties for any marketing purposes.

CGC do not process or collect any Special Categories of Personal Data about you (which includes details about your race, ethnicity, religion, philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, genetic or biometric data or criminal convictions and offences).

3)      If you fail to provide personal data

Where you fail to provide personal data when requested, CGC may not be able to perform the contract it has or is trying to enter into.  In this case, CGC may have to cancel the Services but we will notify you if this is the case, at the time.

4)      How is your personal data collected?

CGC use different methods to collect personal data from and about you including through:

Direct interactions - You may give us your identity, contact and financial data by filling in forms or corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  •          Apply for products or services
  •          Give us feedback or complete a survey
  •          Request marketing to be sent to you
  •          Create an account on our websites

Third Parties – we may receive personal data about you from various Third parties, if you have ordered our products from them.

We use the latest secure server technology to ensure this information is protected to the highest standards.  We use encryption to safeguard your card information and only accept orders from web browsers that permit communication through Secure Socket Layer (SSL) technology - this means you cannot inadvertently place an order through an unsecured connection. Most web browsers above version three support this security. This encryption makes it virtually impossible for unauthorised parties to read any information that you send us. 

We employ firewall software that will only leave your information on our website until it has been registered in our off line systems. Our website is tested and certified by Sophos daily to ensure that our website protects you from identity theft, viruses and other online threats.

6)      Change of purpose

7)      How your personal data may be shared

Personal data that CGC collects in accordance with this Privacy Policy may be shared as follows:

  • With agents (including credit reference agencies, credit card clearing agencies (Commidea and WorldPay);
  • With Third party consultants and despatch providers selected by CGC, such as IT support providers and Logistic companies and for mailing and fulfilment purposes;
  • Fraud prevention and detection agencies that we use to process the orders you place with us or who assist us in the service we provide to you. In these instances, we provide them with only the information they need to perform their function;
  • In the unlikely event that our business assets are ever sold to or purchased by another company (our data records are part of our business); and would, therefore, pass to the new owners.
  • We may monitor customer traffic patterns, Site usage and related Site information in order to maximise your use of the site. But this information will not include any personal information identifying you.

8) How CGC stores personal data

CGC stores your personal data securely within the UK.

We have put in place appropriate security measures to prevent your personal data from being accidently lost, used or accessed in an unauthorised way, altered or disclosed.  In addition, we limit access to your personal data to only those employees, agents, contractors and other third parties that we may use who have a business need to know.  They will only process your personal data on our instruction and they are subject to a duty of confidentiality.

9)      Personal Data Retention

We only retain your personal data for as long as necessary to fulfil the purposes we collected it for, which include satisfying any legal, accounting or reporting requirements.  In general we keep personal data in accordance with our own internal data retention procedures, which are determined by regulatory/legal obligations and good practise.  These retention periods depend on the nature of the information and are subject to change, should you have any questions regarding this, please contact us directly.

Should you wish to exercise you right to erasure or where information is deleted in accordance with CGC’s retention policy, note that after the deletion of your personal data, it cannot be recovered, therefore should you require a copy of this personal data, please request during the period CGC retains the data.

11) Children

The CGC website and company as whole is not intended for children.  CGC will not knowingly collect any personal data from persons under the age of 18 and will immediately delete such data should it be identified.

12) Complaints

If you would like to make a complaint in relation to how CGC may have stored, used or processed your personal data, you have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). However, CGC would appreciate the chance to deal with your concerns before you approach the ICO, so please contact us in the first instance.

As and when necessary, changes to this privacy policy will be posted here.  Where changes are significant, we may also email our registered customers with the new details, and where required by law, will obtain your consent to these changes.
